Grounds for the dismissal of a soldier

Article 51 defines the grounds for dismissal from military service (Law "On Military Service"). The list is quite wide and, first of all, explains how to quit military service under a contract or leave of your own free will from military service in the army (by the way, in this case, the death of one of the close relatives while serving in the army or during fulfillment of their official duties if he was in the military).

The main reasons why a soldier has the right to quit at will:

  • health problems. In this case, a conclusion of a medical examination must be mandatory.   • inability to support a family on the salary of a military man. In this case, not a subjective view on this issue is taken into account, but a very specific objective indicator: it takes into account living wage for each family member and, accordingly, for the whole family and then compared with the military salary (this applies to contract employees);
  • the presence of higher education, which differs from the specifics of the work of the military. If a military man wants to work in his specialty, then he has the right to leave military service;
  • failure to comply with the terms of the contract. In this case, most often we are talking about payments and bonuses that were originally provided for by the terms of the contract. But here the procedure is as follows: first, the serviceman must submit a report to the leadership with a request to resolve the situation. If there is no reaction, then only then can he write a letter of resignation, referring to this reason.

In addition, the legislation also provides for the grounds on which an employee can be dismissed against his will. These grounds are specified in Art. 51 of the Law "On military service".

  • - dismissal of a serviceman due to the age limit;
  • - dismissal of a serviceman at the end of the contract;
  • - due to health problems;

If there is a dismissal at the end of the contract, then there are no special subtleties. The dismissal order is prepared in advance on the basis of the expiration of the urgent employment contract. Early retirement from military service

The current circumstances and lack of knowledge of legal norms lead to the fact that the serviceman is ready to be dismissed under any article, without thinking about the consequences.

The law provides for the possibility of early dismissal from military service under a contract.   • change in the staffing table (if the position of a military man is abolished according to the OSHM);

  2. The fighter needs to have on hand the documents that substantiated the specified reason (if the military decided to leave for health reasons, he can file a report based on the results of medical examinations, and the commander in this case is obliged to send him to the VVK on his own).
  3. A person liable for military service needs to have a conversation with the leadership, where the commander finds out the circumstances forcing the soldier to leave the Armed Forces, and also offers possible options for continuing the service, taking into account the information received (after that, a document is drawn up reflecting the content and results of the negotiations).
  4. The commander collects documents (personal file, report, conversation sheet, etc.), sends them to the certification commission, after which it decides whether it is possible to release the army man from service.
  5. It is required to obtain a decision from the commission, the commander must familiarize the military man applying for dismissal with it.
  6. If the decision is positive, the head issues an order in part, and starts the procedure for expelling a military man from the RF Armed Forces, determining its period.
  7. During the specified time, the contractor is obliged to calculate (give him the money due, resolve issues on food, clothing and housing), and prepare documents for transfer to the commissariat at the place of future residence of the serviceman.
  8. The established period ends with the exclusion of the serviceman from the lists of personnel of the unit.

The procedure for early dismissal initiated by the head of the military is similar. If the consent of the army man is not required, then there is no need for only one thing - in the report of the dismissed person.

The timing of exclusion from the lists of personnel depends on the date of issuance of the dismissal order. From the moment the extract from him arrives at the military unit, no more than a month is given for the exclusion of the specified army man from the personnel.

There are rare cases when during this period a fighter is:

  • on treatment in a hospital;
  • in maternity leave;
  • on parental leave;
  • in a military campaign;
  • in captivity;
  • in the guardhouse or under the control of the commander for the offense committed.

Early dismissal cannot be formalized in such a way that the period of exclusion from the lists of personnel falls on a date that is later than the date the contract ends.

Consequences of dismissal

Early dismissal from the army does not have any special consequences if the article under which the serviceman was expelled from the ranks of the Armed Forces is not related to violations of the order of service.

Reduction of position (OSHM), termination of the contract due to age or health status retains for the army man all social guarantees and payments that he deserved at the time of dismissal.

In addition, it is impossible to forcibly dismiss a military man on the above grounds if:

  • he has not yet served the period required before the appointment of a pension;
  • issue not resolved housing, and the serviceman is on the list of those in need.

The right to receive an apartment from the state is legally assigned to those whose service life exceeds 10 years.

If the dismissal was made on grounds related to the guilty actions of the military, he receives only the DD that was due at the time of leaving, losing all additional compensation, benefits and benefits.

Despite this, fighters are often fired under NUK, provoking them into an administrative or disciplinary violation, fabricating personal cards, and sometimes even in the absence of any penalties simply “under the article”. Some citizens, desperate to achieve dismissal, write a report on themselves, indicating the reason for the NUK, while they consciously believe that they will somehow manage without compensations and benefits.

Such a hasty decision can lead to very disastrous consequences in the civilian world.

For such military personnel, the possibilities are practically closed:

  • continue the service, if such a desire arises;
  • get a job in a law enforcement or military department;
  • get a position in government structures.

  • if the service has become a burden, it is better to choose another reason for its termination, or to endure until the end of the contract;

Welcome! In Russia, military mortgage is called state program, created in order to provide officers and ensigns with modern living space. A retired military mortgage can be a real lifesaver for career officers who have devoted their entire lives to the military and need their own housing when they retire.

This program operates with the help of NIS (accumulative mortgage system), which was born in 2005, as an attempt to solve the topical problem of providing military contractors with housing. The housing program that existed before, according to which the military had to receive apartments in houses built for them, turned out to be ineffective in practice for a number of objective reasons.

The situation is completely different with the modern NIS - its participants, without significant effort, can eventually become owners of their own housing in a period of three to six years.

Members of the NIS have certain rights, and to improve living conditions in the described 10th Art. Fed. Law No117 cases, they have the right to use the accumulated funds from their individual account.

They have the right:

  • purchase apartments for the capital on their accounts, as well as for the funds referred to in Article 4 (part one) of Federal Law No. 117;
  • in order to reimburse the taken target loan, the NIS member can also withdraw money from his savings account;
  • buy housing with a targeted loan and (or) mortgage according to the rules referred to in Art. 14 and 15th law No117;
  • NIS participant can annually receive information about the balances on his individual account in the executive authorities at the place of military service.

Reasons for leaving the army and the consequences for mortgages

The reasons for the dismissal of a soldier from the army may be different, and their results for payment mortgage debt are also not the same. In some cases, payments on obligations can be repaid from the state budget, or vice versa, paid from the budget of the recipient of the mortgage loan.

The list of benefits for servicing a mortgage includes the following circumstances:

  • achievement by the military personnel of the maximum period of his work in the Armed Forces;
  • reduction associated with operational and regular activities;
  • incomplete suitability of a soldier for official duties;
  • the departure of a serviceman from service due to difficult circumstances in the family;
  • complete unfitness for service.

The military also enjoy certain benefits associated with experience:

  • Officers with more than 20 years of experience who have not used mortgage services may apply additional savings to their accounts at their own discretion.
  • If the length of service for military service is less than 10 years, the serviceman cannot withdraw his savings, and he will have to return the amount of the TsZhZ.
  • If the length of service of a serviceman exceeds 10 years, he may qualify for additional payments and savings on his account. And after the dismissal, he can use the received budget money and continue to pay the mortgage loan on his own.

Dismissal without the right to preferential terms on a mortgage

In some cases, the NIS participant has to return the used savings to the state. As a rule, this happens if a soldier leaves for the following reasons:

  • after the submitted application of their own free will;
  • in case of non-fulfillment of contractual obligations under a mortgage agreement;
  • on the benefits of an employee whose service record is less than ten years.

When leaving military service in the above situations, the former member of the NIS must return to the state the funds that he received under the target loan. The same amount will include the first installment for housing and monthly payments that were made on mortgage loan. In addition, in the future, the serviceman is obliged to repay the balance of the debt to the bank on time.

A former member of the NIS must pay off his debts to the FGKU within a period of up to ten years. After paying this amount and paying bank loan, the encumbrance (restrictions on the rights to housing) is removed from the living space of the former debtor, and then the officer becomes the full owner of the apartment.

The procedure for paying a mortgage to the military after dismissal

What can an officer do to receive payments if he is entitled to a subsidy for the purchase of housing? In such a case, the applicant for a subsidy has the right to receive a certain amount of money from Rosvoenipoteka. To do this, the applicant for a subsidy must go through the appropriate stages of obtaining a mortgage:

  • having received an order for his dismissal, the military must submit a report to the military unit for the issuance of a certain amount from his personal account.
  • The military unit will transfer the required data to the authorities, and then this information will be sent to Rosvoenipoteka.
  • The data will be processed, and within one month the ensign or officer can receive a transfer from his savings account.
  • In addition, if a military man is included in the list of persons entitled to benefits for payments upon dismissal, then he will receive the rights not only to receive a certain amount from an individual account, but also to additional subsidies for the purchase of the housing he needs.
  • Only officers who do not use housing for social rent or are already owners of housing can apply for state subsidies after dismissal.

As a result, it turns out that officers whose length of service in the Armed Forces is at least 20 years old, and those officers and warrant officers who resigned for preferential reasons after 10 years of service, can use the military lending service upon dismissal. In addition, if the length of service is 20 full years, then the military has the right to use the NIS loan as it sees fit. The same rights are available to regular officers with a length of service of 10 years or more, who were also dismissed for a reason that falls under the list of benefits. With such a dismissal, if the length of service of a soldier is 10 years, he is also entitled to the capital accumulated in his personal account.

The recipient of the loan may not give this money to the state, but he must pay the rest of the mortgage on his own, while retaining the right to compensation. Of course, if at the same time he does not use an apartment received under a social loan. In such a situation, the preferential interest rate will be retained.

If the military does not repay the debt

If an officer who is a member of the NIS terminates the contract before his service has reached 20 years, he is obliged:

  • Pay off your debts by paying the full amount from your personal funds. The lending party has the right to change the amount of monthly payments in the manner prescribed for borrowers who do not participate in the investment system.
  • The mortgage payer must return the money with interest on the target housing loan, which were provided by ROSVOENIPOTEKA for the first payment of the installment for housing and the payment of the loan (the repayment of the CHL takes place over a period of no more than ten years). The repayment of the debt takes place with the accrual of interest specified in the agreement on the provision of CHL, in equal monthly payments.
  • If a serviceman refuses to pay the CHL and the loan, then these amounts will be collected from him forcibly, in the manner prescribed by law. Due to the fact that, as a rule, the purchased housing acts as security for the loan, the lender has the right to demand the sale of the borrower's housing under the hammer. And the funds from the sale of this property will partially or completely go to the creditor in the form of debt payment.

If the dismissed person enters into a new contract

Many military personnel have a question about what happens to the money in their savings personal accounts or with loans taken on mortgages in cases where:

  1. the serviceman leaves his place of service;
  2. the military man was withdrawn from the list of participants in the investment system, but again goes to serve;
  3. an officer or warrant officer is listed in the investment register, but wants to change his place of service.

After the officer leaves, he is automatically excluded from the NIS lists, and his savings account is closed.

The further fate of these funds depends on his seniority, and for what reason there was a resignation. If one of the reasons was:

  • dismissal for health reasons;
  • OSHM processes (organizational and staff activities) that occurred in its part;
  • problematic family circumstances;
  • retirement due to age,

- the state considers these circumstances to be valid, and the savings are subject to restoration.
If he quit for another reason, then the funds are not restored and must be returned to federal budget. The same is true with the CZHZ agreement: the money must be returned in installments up to ten years, plus interest at a special rate of the Central Bank of the Russian Federation, which will be calculated from the date of the officer's dismissal.

When a new contract is concluded, the officer's data is mandatory entered into the register of the investment accumulation system, and the cash receipts are transferred to the newly created account.

For officers newly enlisted in the Armed Forces, there are three compelling circumstances for re-entering them into the register lists:

  • Recovery financial resources on a savings personal account occurs if officers came to serve from the reserve after they were excluded from the register due to leaving military service.

This could happen for the following reasons:

  • due to poor health;
  • on circumstances related to the OSHM;
  • on problems related to the family;

- if they have not previously received the payment of accumulative financial resources.

  • The law does not provide for the restoration of savings if warrant officers or officers at one time did not wish to become members of the state mortgage system, or they were excluded from the register for reasons that are not considered valid.
  • If they were enlisted in the ranks of the Armed Forces from the reserve, struck off the register and received payments additional funds, they can be re-included in the register after twenty years of service in the army.
