In accordance with Article 6.1 of the Federal Law of October 2, 2007 No. 229-FZ “On Enforcement Proceedings”, the Federal Bailiff Service creates and maintains a database of enforcement proceedings in electronic form. It is in the order of things that parents are obliged to support a minor child, and the duty of able-bodied family members is to care for and provide for loved ones who cannot take care of themselves.

What is also enshrined at the legislative level, which provides for the payment of alimony for the maintenance of the child in the event of a divorce of the parents, and for disabled relatives. The amount of alimony and the procedure for payments is determined by the court on the basis of the law.

In case of deliberate evasion of this obligation, the Criminal Code of the Russian Federation provides for quite a serious punishment.

In addition, there are situations when deductions occur in violation of the established schedule or less than expected. The recipient has the right to recover from the payer a penalty amount in case of late deductions (Article 115 of the Family Code of the Russian Federation), which is 0.5% per day of the amount of the debt. In addition to alimony, fines and penalties may be assessed by court order.

The recipient has the right to apply to the judicial authorities with a claim to recover from the debtor the full amount of the debt.

Under certain circumstances (for example, for health reasons, lack of a permanent job), payments are suspended. The amount owed is determined by the bailiff. It is possible to obtain information on this debt not only to the debtor, but also to the person in whose favor alimony is assigned.

If the payer does not pay alimony and he has good reasons for this, or the amount of debt is incommensurate with his income level, then on the basis of Article 114 of the Family Code of the Russian Federation he can claim to reduce the amount of debt or write it off completely.

In the Family Code (articles 107,113) are defined in cases of this kind: limitation period does not apply if the payer has no valid reasons. Thus, the debt can be collected even after the child reaches 18 years of age.

The plaintiff has the right to demand the payment of alimony not only from the moment of applying to the judicial authorities, but also for the previous 3 years.

There are situations when the payer or recipient of alimony needs to find out information about the existing debt. At present, this is not very difficult to do.

Please note: you can get into any databases of alimony debtors only if the recovery procedure by bailiffs has already begun. If the bailiffs did not receive the case, although there is an agreement on alimony, then you will have to calculate the amount yourself.
