15. Works on the reconstruction and (or) redevelopment of premises in an apartment building, the production of which requires an appropriate permit,
are carried out by an organization that has a certificate of admission to such work, issued by a self-regulatory organization.

III. Composition, sequence, features, deadlines for the implementation of administrative procedures, requirements for the order of their implementation, including in electronic form

3.2.1.5. If the premises (apartment building) is an object of cultural heritage or an identified object of cultural heritage, within 5 days from the date of receipt of the application and documents, sends copies of documents to the Department of Cultural Heritage of the City of Moscow to obtain an opinion on the admissibility of the reconstruction and (or) redevelopment of residential ( non-residential) premises in an apartment building.
The Department of Cultural Heritage of the City of Moscow, within 15 days, submits a conclusion on the admissibility of the reorganization and (or) redevelopment of premises in an apartment building, including those drawn up on the basis of an appropriate conclusion in the form of acts of state historical and cultural expertise, necessary if:

The room is a memorial apartment or a room in a memorial apartment;
- the premises is an apartment or room, the planning structure and (or) the appearance and interior of which relate to the features of the cultural heritage object, which constitute its subject of protection and are subject to mandatory preservation;
- the performance of works on the reconstruction and (or) redevelopment of premises in an apartment building affects the common property

2.14. The decision to agree on the reorganization and (or) redevelopment of premises in an apartment building (Appendix 3 to this

2.14.2. Within 35 days from the date of receipt of the application and the set of documents specified in paragraph 2.10 of these Regulations, if
the premises (apartment building) is an object of cultural heritage or an identified object of cultural heritage.

11. 12. The originals of the conclusions in the form of acts of the state historical and cultural expertise, the originals of the minutes of the meetings of the commission of experts, copies of contracts with experts and copies of the security obligation are attached (in 2 copies) to the project of adaptation for modern use, provided that:
- the room is a memorial apartment or a room in a memorial apartment;
- the premises is an apartment or room, the planning structure and (or) the appearance and interior of which relate to the features of the cultural heritage object, which constitute its subject of protection and are subject to mandatory preservation;
- the performance of works on the reconstruction and (or) redevelopment of premises in an apartment building has an impact on the common property in an apartment building - a monument that constitutes its subject of protection and is subject to mandatory preservation;
- the performance of works on the reconstruction and (or) redevelopment of a room, apartment, house - a monument changes the size, proportions and parameters of such a house:
its height, number of storeys, angle and (or) appearance of the roof or roof (including the installation (liquidation) of mansards, windows, verandas, terraces, awnings), the number and (or) shape of window and door openings in the outer walls of the house (in including the installation (liquidation) of outdoor vestibules, porches, shop windows), color schemes and (or) the appearance of the exterior walls of the house (including the installation (liquidation) of loggias, balconies, facade decor elements), installation of air conditioners and other attachments (for except for the cases of their placement on the courtyard facades).

Legalizing the redevelopment of an apartment in a building that is included in the register of cultural heritage sites is an order of magnitude more difficult than in a typical high-rise building. Moscow legislation in the field of redevelopment requires owners of apartments in historical buildings to coordinate with the supervisory authorities not a redevelopment project, but an adaptation project for modern use (see clause 14 of Appendix 1 of PPM No. 508 in edition 840).

What is it? Law N 73-FZ of June 25, 2002 "On objects of cultural heritage ..." in part of Article 44 gives the following definition:

"Adaptation of a cultural heritage object for modern use is research, design and production work carried out in order to create conditions for the modern use of a cultural heritage object without changing its features that make up the subject of protection, including the restoration of elements of historical and cultural value object of cultural heritage".

That is, when making redevelopment, it is necessary not only to take into account the wishes of the owner, but also to preserve those characteristics that caused the building, or the apartment itself, to be included in the list of cultural and historical values ​​and are the subject of state protection. The adaptation project, which must be approved by the Department of Cultural Heritage of Moscow (Moskomnaslediye), is developed if the replanned premises are a memorial apartment or a room in it, or its layout is of historical value, or the state-protected common property of the residents of the memorial house is affected, or the appearance changes and dimensions of the historic building. Permission to carry out work on the adaptation project is issued by the Moscow Housing Inspectorate after agreement with the Moscow Heritage Committee.

Before developing a fixture project, you should contact the one-stop shop of the Moscow Heritage Committee with an application for registration Conclusions on the admissibility of redevelopment in a room that is an object of cultural heritage or is located in a house that is this object. In accordance with the Agreement on the procedure for interaction between the Moscow Housing Inspectorate and the Department of Cultural Heritage dated 01.12.2011, this conclusion is issued up to 15 days. In particular, it provides information about the existing or lost historical planning, stipulates, if necessary, additional surveys or design work, specifies the requirements for the reconstruction of the lost elements of the facade or interiors, etc.

In addition, the owner of an apartment in a monument building must take responsibility for security obligation, which is issued in the form of an official document in the Moscow Heritage Committee. To do this, you should apply to the "one window" of the Department with a statement. This obligation is an encumbrance of the right of ownership and implies a number of conditions and restrictions. For example, the owner must, at his own expense, maintain the object in a standard condition, repair its engineering systems and let the Department's employees in for inspection (at least once every two years).

An addition to the security obligation is Act of technical condition, which states what exactly constitutes the subject of protection, and also describes in detail the state of structures, communications and decor. This act, in particular, obliges the owner of the apartment to provide to the Moscow Heritage Committee project documentation and any other similar materials within 10 days after receiving them.

The security obligation and the act of technical condition are issued within 45 days from the date of application. Application forms can be found on the official website of the Department.

Design work related to cultural heritage sites and subject to approval by the monument protection authorities can only be carried out by legal entities that have the appropriate license (SRO permit) to carry out them. In addition, the project must pass the state historical and cultural expertise in an organization certified by the Ministry of Culture - to justify or correct the work envisaged by it. From Moskomnasledie, the Department for the Preservation and Use of Cultural Heritage Objects is engaged in expert activities, which, among other things, controls the fulfillment of security obligations and can develop projects for adapting buildings and premises to a modern function.

For getting permits and assignments for repairs and adaptations for modern use, individuals in the "one window" of the Moscow Heritage Committee are served with the following mandatory papers (in 3 copies):

A copy of the identity document of the applicant.

Power of attorney for a representative (if any).
- A certified copy of the contractor's agreement and a copy of the contractor's license.
a certified copy of the contract with the designer for field supervision and a copy of his license.

A certified copy of the design documentation (except when it was developed by the Department of Design Documentation of the Moscow Heritage Committee).

On the applicant's own initiative, a copy of the document confirming the property rights to the apartment (Certificate of registration of ownership or otherwise) is provided.

In addition, in accordance with paragraph 12 of Appendix 3 to PPM No. 508 in edition 840, the project of adaptation for modern use is attached (in 2 copies):

Acts of historical and cultural expertise.
- minutes of meetings of the expert commission.
- copies of contracts with experts.
- copies of the security obligation.

Project development procedure

The procedure for developing the INPP begins with the submission of an application to a single one-stop shop. Within fifteen calendar days, a conclusion is drawn up on the admissibility of redevelopment, containing detailed information on the state of the object before and after the redevelopment, all the necessary calculated data, a list of design work and additional surveys, if required by the project.

To issue a security obligation, you should also contact the “one stop shop” service. This document burdens the owner with a number of obligations, including the maintenance of the condition of the object provided for by the relevant standards and its engineering systems. The owner does not have the right to interfere with inspections by inspectors of the Moscow Heritage Committee, which are carried out at least once every two years.

Additionally, along with a security obligation, the apartment owner who submitted the application is issued a technical condition certificate that contains information about the subject of protection, the main characteristics of the house, the current state of communication systems, interior decoration, load-bearing structures. All required forms can be taken on the website of the Moscow Heritage Committee. Applications will be considered within forty-five days, as prescribed in the regulations, after which the owner receives an act of technical condition and a security obligation.

Coordination of the redevelopment of an apartment in a building that is an object of cultural heritage (monument house) is accompanied by a number of difficulties in comparison with the redevelopment of standard apartments.

Most of the residential buildings of the Central Administrative District are located in historical territories and in zones of protection of cultural heritage sites. Despite past renovations, many buildings are dilapidated and require fairly complex repairs, which are classified as redevelopment.
