Construction is a fairly broad field of activity. You can build houses, industrial buildings, sports facilities, engineering structures and roads. Each direction is a multi-stage process with its own nuances, subtleties and variety of activities: from design to commissioning of the facility. Everyone should know and adhere to them, be it an individual entrepreneur or a legal entity.

All business activities permitted on the territory of our country are divided into sectors, each of which is assigned a specific digital code in accordance with the All-Russian Classifier (OK). Thus, the code is interpreted as a code according to the All-Russian Classifier of Economic Types of Activities.

Every aspiring businessman, before registering with the tax authority, must determine for himself the direction and type of activity, i.e. what exactly his company will do. This information must be indicated in the registration application itself and in the “Charter of the company”. If there are several planned directions, then you should choose one, the main (MA) type of activity:

  • For commercial enterprises, this is the type that brings in the largest portion of the enterprise’s revenue and constitutes the main percentage of its profitability
  • For non-profit organizations, this is the labor sector where the bulk of all involved employees are employed

Having decided on the main VD, you should make sure that it is not prohibited and choose the correct OKVED code for it. This is quite simple to do: there are 21 main sections with the corresponding letter. Construction belongs to section “F”, has three classes, several subclasses of groups and subgroups.

The full structure of OKVED is a six-digit numeric code, where:

  • the first two digits indicate the VD class (for example, Construction of buildings - 41)
  • the third corresponds to the subclass
  • fourth - to the group
  • fifth – to the subgroup
  • sixth – type of activity

Thus, the OKVED code can be presented in the form of numbers from two to six. Moreover, the application for registration must indicate at least three, and preferably four, numbers, otherwise registration will be denied. The possible choice of taxation system, the amount of taxes and insurance contributions (taking into account production risk and the likelihood of developing occupational diseases) will depend on this code.

An entrepreneur may need this set of numbers for:

  • Maintaining and submitting accounting and tax reporting
  • Filling out payment orders and receipts for paying taxes and contributions
  • Applying for a loan, with partners and investors

An error in choice can lead to overpayment of taxes and fees, as well as penalties when carrying out unauthorized or unregistered activities.

OKVED code - construction: what does it include?

So, section “F” is allocated to this industry in the new OK. What works, services and VA correspond to it? First of all this:


In a word, everything related to the construction of buildings and their preparation for subsequent operation belongs to the “Construction” section, which consists of three subsections that have a specific meaning:

  • Construction of buildings (41)
  • Engineering structures (42)
  • Specialized construction work (43)

All of them can be carried out by the organization independently or with the involvement of subcontractors. Let's look at each of these subsections in more detail.

Building

This subsection is assigned OKVED code – 41, it includes the following work activities:


This subsection includes four main groups:

  • 41.1 – work related to design
  • 41.10 – design of residential or non-residential buildings, implying further implementation of the project and operation of the building erected on it
  • 41.2 – work related to the construction of non-residential and residential buildings
  • 41.20 – construction of type “B” buildings.

The last group includes:

  1. Construction of housing of all types: houses of various heights, cottages (including individual orders, log and panel houses)
  2. Construction of non-residential facilities:
  • Industrial – these are: factories, factories, workshops, services, etc.
  • Sports – halls, stadiums and grounds
  • Commercial – shops, offices, shopping centers, markets, etc.
  • Administrative and service – clubs, cultural centers, hotels, restaurants
  • Household - sheds, garages, cottages, bathhouses, underground parking, etc.

This does not include: project management, execution and organization of architectural work, and assembly of industrial structures (other than buildings).

Construction of engineering structures

This class is registered under code 42 and includes the creation of new (capital or temporary) structures, as well as the repair and restoration of existing ones. It is divided into two main and several smaller subgroups.

42.1 – Road construction.

42.11 – laying of highways, highways and highways, this also includes street networks, pedestrian crossings and sidewalks, as well as work on:

  • application and renewal of road surfaces
  • placement of road barriers and signs
  • markup update and layout

42.12 – work related to the construction of railways and metro, in particular: construction of railway, tram and metro tracks.

42.13 – construction of bridges and tunnels. This also includes overpasses and overpasses.

This group and its subsections do not include: street lighting and placement of traffic lights, management, architectural work.

42.2 – Creating communications.

42.21 – construction of systems and structures designed to supply populated areas with gas and water:

  • Equipment for pipelines for various purposes, tanks, water pipelines and irrigation systems, pumping and treatment stations
  • Repair of the above structures

42.22 – creation of electrical power and telecommunication systems:

  • Laying distribution lines for the supply of electrical energy, as well as creating structures necessary for their full operation (panel rooms, substations, etc.)
  • Construction of facilities to ensure the functionality of energy and communication lines. This also includes laying cables and placing antennas.

This group does not contain engineering consulting and design.

42. 9 – Other structures.

42.91 – water (locks and dams), irrigation systems. This group includes:

  • 42.91.1 – construction of port structures
  • 42.91.2 – hydraulic
  • 42.91.3 – irrigation systems
  • 42.91.4 – performance of work related to the cleaning and deepening of reservoirs, strengthening of coastlines

42.99 – construction of other structures that do not belong to well-known groups.

This group does not include: assembly and dismantling of industrial equipment, surveying of undeveloped lands.

Carrying out specialized construction work

This concept combines many works of narrow specialization: roofing, frame, concrete, etc. The group was assigned code 43 in the OKVED directory. This includes four main ones and several additional ones:

43.1 – Preparation of sites and areas for the process:


  1. 43.12.1 – clearing of waste from sites
  2. 43.12.2 – provision of drainage
  3. 43.12.3 – earthen
  4. 43.12.4 – preparation of the area before mineral extraction (except oil and gas)

43.2 – Construction and electrical installation, as well as plumbing work:

  • 43.21 – electrical installation: supplying and connecting electrical wiring, Internet, cable television, etc. Installation of alarms and antenna equipment.
  • 43.22 – installation and dismantling of ventilation and heating systems (the group does not include the installation of electric heating systems).
  • 43.29 – installation and construction work: automatic doors, elevators, lightning rods, sound/heat insulation.

43.3 – Finishing work:

  • 43.31 – plastering
  • 43.32 – joinery and carpentry
  • 43.33 – facing
  • 43.34 – painting and glass work
  • 43.39 – final

43.9 – Other special works:


  1. 43.99.1 – waterproofing
  2. 43.99.2 – construction of auxiliary devices
  3. 43.99.3 – installation of piles and pouring of the foundation
  4. 43.99.4 – concrete/reinforced concrete work
  5. 43.99.5 – installation of metal structures (provided that they were produced by another organization)
  6. 43.99.6 – execution of stone or brickwork
  7. 43.99.7 – installation/dismantling of prefabricated structures
  8. 43.99.9 – other services not included in other groups

This is how various VDs are classified. Determining the correct code for your direction is quite simple.

Innovations in OKVED codes

Since July 2016, a new classifier (OKVED-2) has come into force on the basis of Order No. 14 of Rosstandart dated January 31, 2014. New organizations will be registered in accordance with it, and for existing ones, information in the Unified State Register of Individual Entrepreneurs will be changed automatically.

According to data that has lost its validity since 07/11/2016, construction was listed in the directory under code 45. Thus, many types of activities changed their OKVED in the coming year. This fact must be taken into account when submitting reports and filling out payment orders.

Otherwise, it turns out that the enterprise did not carry out the activities that were registered. This violation may result in sanctions or transfer to the general taxation system, which is quite expensive for many individual entrepreneurs.

Therefore, all changes and reforms related to OKVED need to be closely and carefully monitored. At the moment, it is recommended that each organization check its codes with the new directory and a new extract from the Unified State Register of Legal Entities or the Unified State Register of Individual Entrepreneurs. Real people work in the tax service, and sometimes they make mistakes. If the new statement contains incorrect codes, you should contact the tax office and resolve the situation as soon as possible.

Each entrepreneur can indicate as many codes as he wishes, as well as supplement or change their list. This is not prohibited by law, but each VD must be registered and indicated under the current OKVED code. Timely and constant vigilance will help avoid many troubles and misunderstandings in the future.

General construction includes:

43 Specialized construction works
This grouping includes:
- special construction activities (special industries), i.e. construction of parts of buildings and civil engineering works or preparation
This activity usually specializes in one aspect common to different structures that requires special skills or equipment, such as piling, foundation work, framing work, concrete work, bricklaying work, stone laying, pitching, roofing, etc. d. The erection of steel structures may be included here provided that the parts are not manufactured by the same department. Special construction activities are primarily carried out under a subcontract, especially renovations where they are carried out directly for the property owner. This also includes the final treatment of buildings upon completion of construction. This includes the installation of devices for the operability of the building. Activities to ensure operability are usually carried out on the construction site, although parts of the work may be carried out in a special workshop. This also includes plumbing work, as well as work on the installation of heating and air conditioning systems, antennas, alarm systems and other electrical work, work on the installation of fire alarm systems, elevators, escalators, etc. This also includes work on water, heat and sound insulation, sheet metal cladding, installation of commercial refrigeration units, installation of lighting and signal systems for roads, railways, airports, ports, etc. This also includes repair work for all types of the above work. How to find construction OKVED in the classifier

The legal form of an enterprise engaged in construction can be any - legal entity or individual entrepreneur. Construction in the OKVED directory is in section F. Codes should be selected from the updated edition of the OKVED-2 directory, which came into force in 2016.

The section for the construction of buildings and structures contains three classes and several dozen subclasses, as well as groups and subgroups for more precise detailing of the work performed and specializations.

Step-by-step instructions for choosing OKVED codes for construction

Step 1. Decide on a priority direction in the construction industry

Section F is divided into three groups - 41, 42, 43.

Class 41 combines work on the construction of various types of objects:

  • residential and non-residential purposes (standard residential buildings, private projects, buildings of social and public structure, utility buildings);
  • new structures and buildings of all types, carrying out major and current repairs, carrying out additional work.

It also includes work on the preparation of construction projects.

If you do not know exactly which profile of the enterprise will be more profitable, you can choose the main code 41. This will allow the company to engage in general construction work. In addition to construction, it will be possible to take orders for researching the material and technical base, design, and selection of construction technologies.

Class 42 describes a wide range of activities in the construction of buildings and structures of an engineering nature. These include: bridges, underground communications and highways, pipelines, electrical lines, runways for spaceports and airports, etc.

This engineering and technical activity concerns almost all areas - from housing to meeting the military-strategic needs of the country.

But there are a number of restrictions here. Class 42 does not include the construction of sports facilities.

Class 43 presents a list of construction work that does not fall under specific specializations:

  • earthworks;
  • glass equipment;
  • clearing and cleaning of territories;
  • organization and conduct of drilling developments;
  • laying the foundation;
  • conducting preparatory or repair activities.

Simply put, code 43 in OKVED makes it possible to carry out specialized, narrow-profile installation work. This may include pouring concrete, laying a foundation, conducting and installing electrical power systems, plastering, finishing, laying floors, as well as soundproofing work and much more.

Important! Construction and installation works can be included in this structure, provided that parts of the structures were not built by the same organization

In addition to large classes and subclasses, there are also groups, subgroups and individual activities.

The main code usually looks like this: UU.UU.UU, where

УУ - class of activity performed,

Step 2. Make sure that you do not need to obtain a license for this type of activity.

To do this, you should familiarize yourself with the list of activities subject to licensing. They are described in Law No. 99-FZ (52 items are subject to licensing in Russia).

There are significantly more OKVED codes than the types of licensed activities that they designate (that is, one type of activity subject to licensing may have several OKVED codes). The difficulty lies in the fact that they do not have the same names.

Step 3. So, you have decided on OKVED codes for construction. The question arises, where should we include them?

When registering an individual entrepreneur, an application on form P21001 is filled out. OKVED is entered on sheet A. At least four digits of the code are indicated, that is, up to the group.

It is necessary to select the main activity code from the OKVED classifier. The legislation does not limit the number of selected codes, since there can be any number of additional codes. However, it is important for a construction company to correctly determine the main OKVED code (that is, the main type of activity) - according to it, the enterprise’s income must exceed 51% of the total revenue.

Important! Legal entities must confirm their main activity annually. Individual entrepreneurs are not required to do this; they indicate it once - during registration

The complexity of reporting to the Federal Tax Service and the amount of taxes do not directly depend on the selected OKVED. However, for some types of activities there are restrictions on the organizational and legal form, and the ability to use one or another taxation system will depend on this.

The wrong choice of OKVED codes will cause a lot of trouble; in the worst case, the company’s activities may be suspended until the error is corrected. Therefore, it is better to use the help of specialized companies when registering a company, for example.

Changing the OKVED code by a construction company

If this is done without making changes to the company’s charter, you should fill out an application in form P24001. If you decide to change the charter - form P23001.

The application must be sent to the Federal Tax Service at the place of registration of the company within three days from the date of change of business direction. Otherwise, the entrepreneur, in accordance with Art. 14.25 Code of Administrative Offenses of the Russian Federation, faces a fine.
