After Federal Law No. 218-FZ “On State Registration of Real Estate” came into force at the beginning of 2017, the issuance of certificates of title to housing, cadastral passports for real estate and extracts from the unified register of rights was cancelled. These documents will be replaced.

This is an integral part of the state cadastre, containing the following information about a specific apartment:

  • dimensions of common and living areas;
  • year of completion of construction;
  • information about the wall material;
  • floor plan;

  • information about redevelopments.

Since the beginning of 2015, the cadastral passport also contains information about the rights holders of the apartment, information about who and when of the cadastral engineers performed cadastral work on this property, as well as the cadastral value of the apartment.

The cadastral number assigned to the property will not change from now on.

The difference between a cadastral passport and a technical one

In addition to the cadastral passport, the property has a technical passport, but is engaged in its preparation Bureau of Technical Inventory, which is also part of the structure of Rosreestr.

A legitimate question arises: why does one apartment need two, at first glance, identical documents?

A technical passport for a property is drawn up both after the delivery of the property after completion of construction, and for secondary housing.

The technical passport focuses on the description of the technical side of the property, namely:

  • information about the total living areas of the apartment;
  • the area of ​​each room;
  • date of construction and date of major repairs;

And the purpose of drawing up a cadastral passport is transactions with an apartment, transactions with it and registration of ownership rights to real estate.

The cadastral plan contains only general information about the technical side of real estate, and even the area of ​​the apartment is rounded to whole meters, and not indicated to the nearest hundredth, as in the technical passport.

Registration procedure

Ideally, the design is very simple. To do this, you must contact the relevant territorial authority, pay the state fee and upon expiration of the period established by law, pick up the completed documents.

But often, when contacting the Cadastral Chamber, difficulties arise. Namely, your apartment must pass and information about it must be in the cadastre.

According to the law, until the end of the transition period, that is until January 1, 2013 all information from the BTI had to be transferred to the state real estate cadastre. However, due to the unsatisfactory quality of work on the transfer of archival data stored in the BTI, it may happen that information about your apartment may not appear in the cadastre.

Further actions depend on whether you have a technical passport for the apartment, produced before January 1, 2013.

If it is available, then further registration will not require further time expenditure. Having received a notification that information about the apartment is not in the real estate cadastre, you must write an application to the Cadastral Chamber to include information about the property in the cadastre as a previously registered object.

A copy of the registration certificate must be attached to the application.

Based on the application, the Cadastral Chamber will contact the relevant department of the BTI for confirmation, and if everything is in order with the documents, you will receive a cadastral passport.

It may happen that the purchased apartment underwent technical inspection by an organization that was deprived of a license, or that a technical passport was not drawn up for it at all.

In this case, you will have to order the drawing up of a technical plan from a cadastral engineer at your own expense. The cost of drawing up a technical plan for a residential premises can be about 6000 rubles.

It is worth noting that when ordering the services of a cadastral engineer, you can agree on entrusting him with further actions to prepare a cadastral passport for the apartment.

List of documents required to obtain a passport

For any citizen, for any residential property, it is enough to present passports And payment of state duty.

But only the owner can perform any significant legal actions with the apartment, for example, register it in the cadastral register or enter information about redevelopment into the cadastre.

In case of redevelopment, the above list is supplemented by the following documents:

  • technical passport with information after the redevelopment;
  • positive court decision in case of unauthorized redevelopment, etc.

To do this, you can contact the territorial divisions of the Cadastral Chamber, or the nearest multifunctional center (MFC).

In both cases, the employee will issue the necessary forms, check the accuracy of the documents provided, issue a receipt for receipt of the documents and set a date when to apply for the result.

In addition, in the Electronic Services section on the Rosreestr website, you can independently order information online from the register of rights to real estate. In this case, you can choose the method of receiving documents: in the offices of Rosreestr or the Cadastral Chamber, in the offices of the MFC, by mail, electronically, or order field service.

Registration period

The procedure for obtaining a cadastral passport for an apartment takes 5 days from the moment of application.
In case of unforeseen circumstances, which were mentioned above, this period may be significantly delayed, and in case of doubts about the existing documents for real estate, it is better to take this into account in advance.

The initial registration of a property commissioned for construction is carried out directly by the developer, registration takes 18 working days and state duty is not paid.

Registration cost

To order a cadastral passport on paper, the apartment owner is charged a state fee in the amount of 200 rubles, for an electronic copy – 150 rubles.

The amount of payment for field services by employees of the Cadastral Chamber is regulated by internal orders and varies depending on the subject of the federation in the range from 500 to 1500 rubles.

You can pay the state duty either at the departments of the Cadastral Chamber or at any convenient bank.

Possible reasons for refusal of registration

The law provides for only 2 cases in which you may be denied a cadastral passport:

  • if information about the apartment is not in the cadastre;
  • if obtaining information by the applicant is prohibited by law.

If the reasons for the refusal do not fall into this list, you can protest the actions of the Cadastral Chamber employees from its management - a written complaint must be considered within no more than 15 days.

If management refuses to protect your interests, you can go to court.
