Since December 2013, clear amounts of MDV have been designated for payments to military personnel for the purpose of purchasing housing or constructing a residential building (other housing). Who is entitled to EDV for the purchase of housing by military personnel?

Receipt of state financial assistance for the purchase of housing by military personnel is provided to the following categories:

  1. Warrant officers, contract soldiers, officers serving in the armed forces since 1998.
  2. Retired military personnel who were unable to obtain housing during their service.

In addition, there are some exceptions to the rules that allow military personnel who have served in the army for 10 years or more to receive a lump sum payment. Such options are possible if the military unit was reorganized or the citizen was injured during service.

An undoubted disadvantage of the current state of affairs is the service of officers in the army only for the purpose of obtaining living space from the state. How to receive payment to military personnel for the purchase of housing (EDV)?

Thanks to the development of a state program, under the initiative of Defense Minister Sergei Shoigu, material support for the military is provided for the purchase of housing, in an amount that the Ministry of Defense could not provide with direct housing from its own funds. In addition, there will be no strict restrictions on the location of the choice of purchased residential premises.

This state program involves providing single military personnel with at least 15 years of experience with a payment of 3 million rubles. After purchasing their own home, a military man will be able to submit a report for dismissal if he wishes.

If the number of family members of a military personnel is more than three people, the amount of EDV increases three times. By fulfilling a number of necessary conditions and providing documentation specific to a specific region of Russia, you can obtain the right to provide EDV.

New formulas for calculating the monthly allowance for military housing

The calculation of the provision of EDV to military personnel will be determined by a special formula in which the cost of one square meter. meter will be multiplied by the total required living space, and all this will be multiplied by a coefficient implying the length of service of the military man. The cost of a square meter of living space will be taken into account throughout Russia, and the data will be provided by housing authorities and the Ministry of Construction.

Based on standard settings, single military personnel will be able to claim a living space of 33 square meters. m, family – 42 sq. m, and if there are more than three family members, the military must be provided with 18 square meters for each.

In addition, a procedure has been established by which some categories of military can receive an additional 15 square meters. These are military personnel of the highest ranks, military teachers with an academic degree, and commanders of military units.

Increasing factor when calculating EDV

The increasing coefficient, designated as “Kc”, ensures the determination of the length of service for each serviceman. For example, for service from 10 to 16 years, a coefficient of 1.85 applies; for service from 16 to 20 years, a coefficient of 2.25 applies; for those who have served for more than 21 years, the coefficient increases to 2.75 (this coefficient also applies to those families whose serviceman died on duty).

If a serviceman has his own living space and is an applicant for EDV, the estimated housing area will be calculated based on the real difference. It is this difference that will be paid for by the Ministry of Finance. Such rules also apply to military personnel living in municipal housing, if they did not refuse living space.

In addition, when calculating the housing allocated from the state, even that living space that was the property of the person, but was lost by him of his own free will - as a result of sale, donation, etc. will be taken into account.

How to apply for EDV for the purchase of housing for military personnel?

If you wish to apply for an EDV, the serviceman must contact the Pension Fund at the place of service, where you must also provide an application of the established form and the necessary list of documents.

If there are several categories of benefits for payment of benefits, calculations will be made according to the type that involves a larger amount of payment to the military personnel.

EDV rates will be indexed every year. The application must be submitted before April 1, starting in 2016, in order to be among the applicants for the next year.

The point of the program is that the military department will no longer build houses for military personnel. This practice is gradually being phased out and becoming a thing of the past. Those last facilities that began to be built before the decision was made to subsidize the military will be completed in the usual manner and distributed to those first in line for housing. The rest will be given monetary compensation or a so-called military mortgage.

But the Ministry of Defense simply did not have a sufficient number of apartments, and therefore it was possible to wait on the waiting list for years. The approximate number of people waiting in line for an apartment by 2013 was 55-60 thousand people. After military subsidies began to be issued for the independent purchase of housing, this queue was reduced by at least four times in just one and a half to two years.

There is another significant advantage of military subsidies compared to receiving apartments from the military department fund.

Now military personnel, former military personnel, as well as military families who were on the waiting list and received military subsidies instead of departmental housing, have the opportunity to choose a region to purchase or build housing.

Problems may arise only with the purchase of real estate in the most significant cities of Russia, such as St. Petersburg or Moscow. Simply because the price per square meter of living space in these cities is significantly higher than the average for cities in the Russian Federation.

Is everyone entitled to

No, not everyone. First of all, the military subsidy system applies to those who were on the waiting list for housing before 2005. Employees on the waiting list, starting in 2006, are not entitled to military subsidies. All they can count on from the State is a military mortgage.

Those eligible for military subsidies:

  • have served for at least 10 years;
  • having no home of their own;
  • having housing with an area less than normal;

Receipt procedure

First of all, you need to get in line to improve living conditions in your region. Queuing is described and regulated by Article 51 of the Housing Code. The order in which military subsidies should be provided is regulated by the order of the Ministry of Defense:

  1. A person who is in military service, including retired, or his family members are required to open a bank account and apply for a subsidy.
  2. Documents about family composition and the need to improve living conditions should be provided.
  3. Within 10 days after checking the documents, a response is received through the Unified State Register confirming the right of the given serviceman to receive a subsidy.
  4. Within another 10 days provided for by law, the executive body of the Ministry of Defense makes a decision on the accrual of the subsidy, after which the amount is transferred to the bank account declared in the submitted documents.

What will be the subsidy amount?

The calculation of the amount of a military subsidy for military personnel takes into account several specific components. Namely:

  • price per square meter of housing stock in the Russian Federation;
  • the number of family members of a given serviceman, which affects the required number of square meters;
  • length of service (up to 15 years, over 15 years).

As for the service life coefficient, an important component in the formula for calculating military subsidies, it comes in three types:

  1. From 10 to 15 years – 1.85.
  2. From 16 to 20 years old – 2.25.
  3. From 21 years old – 2.5 + 0.07 for each subsequent year.

If the person submitting the request for a subsidy is in a rank higher than captain of the first rank or colonel, as well as if he has an academic degree, an additional 15 square meters are provided by law. m area.

How to calculate correctly

    In the latter case, 5 years must not pass from the date of implementation, otherwise the total area standard will not be reduced.

    Some categories of military personnel have the right to an additional 15 square meters to the total housing area. meters.   3. The length of service of a soldier.

    • from 10 to 16 years - 1.85;

Who can benefit from housing subsidy

A housing subsidy can be received by any person who serves in the army or has been discharged from military service and is recognized as in need of housing in the manner prescribed by law.

It must be said that Federal Law 360-FZ of November 24, 2014 introduced changes to the procedure for receiving subsidies. The amendments affected Article 15 “On the status of military personnel” on the right to choose the type of housing. In particular, the subject composition for receiving subsidies to the military for the purchase of housing has been adjusted. Benefits of housing subsidy for military personnel

Housing subsidies have many advantages compared to other methods of targeted housing support for military personnel:

How is a military personnel recognized as needing housing?

According to the norm of Federal Law N 76-FZ, a military serviceman can be recognized as in need of housing by the executive authorities at the place of their service. The basis for this is Article 51 of the Housing Code of the Russian Federation and the Procedure established by Decree of the Government of the Russian Federation of June 29, 2011 N 512.

To obtain status requiring housing the serviceman must write an application in the established form and send it to the housing department under the executive branch of the constituent entity of the Russian Federation along with additional documents:

1. A copy of the personal passport and a copy of the spouse’s passport and birth certificates of the serviceman’s children;

2. Extract from the service record and certificate of duration of military service;

5. Copies of other documents confirming the right to improve living conditions.

The decision on the issue of recognizing a military person in housing is made within 30 days from the date of submission of the application. The result is reported in writing to the address of residence.

How is military housing subsidy calculated?

It is noteworthy that there are two decrees of the Government of the Russian Federation that determine how to calculate a housing subsidy. The first of them, Decree of the Government of the Russian Federation of February 3, 2014 No. 76, establishes the procedure for calculating housing subsidies in accordance with the standard of total living space and the standard of housing per person.

Secondly, Decree of the Government of the Russian Federation dated October 24, 2013 N 942 provides rules for calculating housing subsidies for military personnel in need of residential premises in excess of the established standard for living space.

To calculate the housing subsidy according to the standard, there is a certain formula:

C - cost per square meter according to the norm in the Russian Federation

Example: An applicant for a subsidy has a family of four people. The standard cost established by the order of the State Construction Committee dated July 18, 2013 No. 269 is 34,350 rubles per 1 sq. m. meter. An officer's service life is 18 years. For officers with such a term, a correction factor is set at 2.25. At the same time, the standard living space for each family member is 18 square meters. meters.

Thus: P = (18 x 4) x 34350 x 2.25 = 5,564,700 rubles.

This amount can be further increased by 15-25 sq. meters, provided that the officer falls under one of the categories established in Federal Law N 76-FZ:

Has a military rank above colonel

Has an honorary title of the Russian Federation

Engaged in teaching or research activities

His health condition worsened during his service in the Armed Forces.

At the same time, officers who have several grounds at once can use only one.

However, it is also provided reduction of the general living space standard . This can be done when a military man or members of his family make civil transactions while living in a residential area, if they are aimed at alienating part of the housing into ownership or transferring its part occupied under a social tenancy agreement back.

If a serviceman died in the line of duty or died after reaching the service age limit, then the calculated adjustment factor will be increased for his family.

If a serviceman wants to purchase housing whose area exceeds the standards established in Article 15 of the Federal Law “On the Status of Military Personnel,” then a different formula applies. Or rather, two whole formulas:

1. P2 = O – H – D – Tk - when the size of the total area is exceeded

2. P = P2 x C - amount of payment for excess area

For example, an officer with the rank of colonel wants to increase the area of ​​future housing to 100 square meters. meters (O in the formula). In this case, the value H represents the standard living space. The law specifies the maximum additional area for this title at 15 square meters. meters (value M in the formula).

T is the maximum size of the area, taking into account the design features of the house or apartment. In this case T = 9 sq. m. meters.

Total: P2= 100 – 72 – 15 – 9 Total 4 sq. meter will be an excess of area over the standard.

According to the second formula, P = P2 x C, in which C is the residual price or the price established by the government contract for 1 sq. m. meter of area, you can get the size to pay 4 sq. meters obtained above the norm. If the price is 1 sq. meter is 34,350 rubles, then the amount of additional payment will be 137,400 rubles.

But you need to know that providing an officer with housing larger than the norms is voluntary and notifying. This means that the decision is made at the command level, and the applicant is notified in writing about such an opportunity in each specific region of the Russian Federation during military service. Such a notice shall indicate all calculations of the cost of housing, taking into account the excess area. The serviceman must pay for the excess area within 20 days from the moment he signs an agreement to exceed the standard area for the subsidy.
