Any company intending to obtain admission and become a member of the SRO must initially study MRR Order No. 624 and familiarize itself with the list of activities before submitting an application to the SRO. The problem is that with the transition from licensing to self-regulation, many company managers mistakenly began to believe that permission would be required for even the simplest finishing and private repairs.

Thus, this bill is a list of hazardous activities in construction and related areas for which it is necessary to obtain SRO permits. However, there is one interesting nuance in the document - some types of work are marked with *. Accordingly, such work is classified as simple, but if it is carried out at hazardous facilities specified in Art. 48.1 of the Civil Code of the Russian Federation, then membership in an SRO will be required.

    What did Order No. 624 bring to the SRO?

    For the work of SRO 624, the Order has become one of the main documents, which is still used daily for preparing permits throughout the country.

    Your permit will immediately include the planned types of work. If in the future this list is not enough, then you contact the SRO to replace the permit.

    2. When you know in advance that work at particularly hazardous sites is included in the customer’s plans, you issue the appropriate permit. The procedure will be supplemented with two mandatory points:

  • registration of ISO 9001
  • increasing the amount of civil liability insurance by 2 times

    It was in this order that the list of construction, design and survey work was approved. After amendments in 2010, the list remained unchanged to this day.

    1. If you never work on particularly dangerous and unique objects and do not even consider such a possibility in the future, then a permit for general construction work is quite sufficient. Here it is important to carefully study incoming orders - the presence of hazardous work at the site may not be obvious.

    Of course, you can immediately issue a permit, which will include absolutely all types of work presented in the list. But such permits are issued only by the largest construction companies, and small businesses simply do not need this.

    When compiling your list of works for joining an SRO, Order 624 should be used as the main source for reconciliation.

    2. Establish that the List does not include types of work on the preparation of design documentation, construction, reconstruction, major repairs in relation to objects for which the issuance of a construction permit is not required in accordance with Part 17 of Article 51 of the Town Planning Code of the Russian Federation (Collection of Legislation Russian Federation, 2005, N 1, Art. 16; 2008, N 30 (Part 2), Art. 3616), as well as in relation to individual housing construction projects (detached residential buildings with no more than three floors, intended for residence of no more than two families); residential buildings with no more than three floors, consisting of several blocks, the number of which does not exceed ten and each of which is intended for one family, has a common wall (common walls) without openings with the neighboring block or neighboring blocks, is located on a separate land plot and has access to public territory (blocked residential buildings); apartment buildings with no more than three floors, consisting of one or more block sections, the number of which does not exceed four, each of which contains several apartments and common areas and each of which has a separate entrance with access to the common area.

    Order on SRO No. 624

    A specific list of types of work in construction, design, and engineering surveys that can only be carried out by a SRO participant is determined by Order 624 of December 30, 2009. The regulatory act was developed by the Ministry of Regional Development to determine the standards that design, construction and repair work that affects the safety of capital construction projects must meet. Order 624 SRO, latest edition, also defines the list of works that can be performed without obtaining permission.

    What work requires a permit?

    In accordance with the regulatory act, the work requiring permission from the SRO - Order 624 of December 30, 2009 includes:

    1. Engineering survey work:
    • work as part of engineering and geodetic surveys;
    • work as part of engineering and geological surveys;
    • work as part of engineering and hydrometeorological surveys;
    • work as part of engineering and environmental surveys;
    • work as part of engineering and geotechnical surveys;
    • inspection of the condition of the foundation soils of buildings and structures.
  • SRO Resolution 624 classifies the following as affecting work safety related to design documentation:
    • on preparing a scheme for the planning organization of a land plot;
    • on preparation of architectural solutions; on preparing constructive solutions;
    • on the preparation of information on external networks of engineering and technical support, on the list of engineering and technical activities;
    • on preparation of technological solutions;
    • on the development of special sections of project documentation;
    • on the preparation of projects for the organization of construction, demolition and dismantling of buildings and structures, extension of service life and conservation;
    • on the preparation of draft environmental protection measures;
    • on preparation of projects of measures to ensure fire safety;
    • on the preparation of draft measures to ensure access for people with limited mobility;
    • on inspection of building structures of buildings and structures;
    • for organizing the preparation of design documentation, attracted by the developer or customer on the basis of a contract by a legal entity or individual entrepreneur (general designer).

    In connection with numerous requests from self-regulatory organizations about the procedure for implementing the order, the Ministry of Regional Development of Russia, in a letter dated June 15, 2010 N 24099-RP/08, gave the following explanations:

    In accordance with Part 9 of Article 55.8 of the Town Planning Code of the Russian Federation (hereinafter - the Code), a certificate of admission to a certain type or types of work that affects the safety of capital construction projects is issued by a self-regulatory organization (hereinafter - SRO) without limiting the period and territory of its validity . Thus, termination does not formally cancel the validity of the clearance certificates issued pursuant to this order. Organizations and individual entrepreneurs have the right to carry out work specified in the certificate issued on the basis of Order of the Ministry of Regional Development of Russia dated December 9, 2008 N 274, and directly provided for by Order N 624.

    At the same time, when implementing Order N 624 in the practice of public and private customers, commissions for holding competitions and auctions, organizations for conducting state examination of design documentation and engineering survey results, state construction supervision bodies, construction control organizations, law enforcement agencies and other bodies and organizations may have difficulties comparing the types of work specified in certificates issued in accordance with and in, since in the latter the types of work are formulated in most cases in a different wording.

    In this regard, from July 1, 2010, in accordance with Part 2 of Article 52 of the Urban Planning Code of the Russian Federation, the Ministry of Regional Development of Russia recommends that persons carrying out engineering surveys, architectural and construction design, construction, reconstruction, major repairs of capital construction projects carry out the types of work specified in the List , approved by order N 624, only after the specified types of work are included in the certificates of approval issued by the SRO.

    Amendments to certificates of approval are carried out in the manner prescribed by parts 10-14 of Article 55.8 of the Town Planning Code of the Russian Federation. Part 10 of this article determines that in order to make changes to the certificate, it is necessary to submit an application for amendments to the SRO. Such an application must be accompanied by documents confirming compliance with the requirements for the issuance of certificates of admission, but only if the member of the SRO intends to obtain a certificate of admission to a different type or types of work that affect the safety of capital construction projects than those required. which are recorded in the certificate issued in accordance with the order of the Ministry of Regional Development of Russia dated December 9, 2008 N 274.

    In connection with the publication of a new edition of the list of types of work, the concept of “other type or types of work” must be understood as work that is different in comparison with those indicated in the certificate of admission not by name, but by the content of the types of work. If the content of the work is the same as that already indicated in the certificate in accordance with the previous edition of the list of types of work, then the application does not need to be accompanied by documents confirming compliance with the requirements for issuing certificates of admission. In this case, in accordance with Part 13 of Article 55.8 of the SRO Code, only the application is subject to verification in order to make a decision on making changes to the admission certificate. To establish the conformity of types of work from the lists approved by orders of the Ministry of Regional Development N 274 and N 624, we propose to use the Table of Conformity of Types of Work (appendix to the letter of the Ministry of Regional Development of the Russian Federation dated June 15, 2010 N 24099-RP/08).

    The entry into force of a new list of types of work affecting the safety of capital construction projects raised many organizational issues, most of which were taken into account when amending the Town Planning Code by Federal Law No. 240-FZ of July 27, 2010.

    2. Analysis of the new list of types of work

    If we compare the new list with the list approved by order of the Ministry of Regional Development of the Russian Federation dated December 9, 2008 N 274, then it can be noted that the new edition of the list significantly reduces the number of types of work in construction, both by removing certain types of work from the list and by account of work consolidation. In numerical terms, the number of types of work was reduced from 779 to 353.

    At the same time, the new list does not include types of work on the preparation of project documentation, construction, reconstruction, and major repairs in relation to the following objects:

    - objects for which the issuance of a construction permit is not required in accordance with Part 17 of Article 51 of the Town Planning Code of the Russian Federation;

    - individual housing construction projects (detached residential buildings with no more than three floors, consisting of several blocks, the number of which does not exceed ten and each of which is intended for one family, has a common wall (common walls) without openings with the neighboring block or neighboring blocks, located on a separate plot of land and has access to a public area (blocked residential buildings);

    - apartment buildings with no more than three floors, consisting of one or more block sections, the number of which does not exceed four, each of which contains several apartments and common areas and each of which has a separate entrance with access to the common area .

    It is worth recalling that, according to the note to the list approved by Order of the Ministry of Regional Development dated December 9, 2008 N 274, it does not apply to work on the preparation of project documentation, construction, reconstruction, major repairs of facilities specified in Part 2 of Article 49 and Part 17 of Article 51 Town Planning Code of the Russian Federation.

    The practical application of the provisions set out in the note to the list, approved by order of the Ministry of Regional Development of December 9, 2008 N 274, made it possible to carry out work without obtaining permission at such facilities as:

    Separate capital construction projects with no more than two floors, a total area of ​​no more than 1,500 square meters and which are not intended for citizens to live in or carry out production activities, with the exception of objects that, in accordance with Article 48_1 of the Civil Code of the Russian Federation, are particularly dangerous , technically complex or unique objects;

    Separate capital construction projects with no more than two floors, a total area of ​​no more than 1,500 square meters, which are intended for production activities and for which the establishment of sanitary protection zones is not required or for which, within the boundaries of land plots, on where such facilities are located, sanitary protection zones have been established or the establishment of such zones is required, with the exception of facilities that, in accordance with Article 48_1 of the Civil Code of the Russian Federation, are particularly dangerous, technically complex or unique.

    The list approved by Order No. 624 does not contain any exceptions in relation to these objects.

    But the new list contains 52 types of work (marked with an asterisk) that require obtaining a certificate of admission only if such work is performed on sites specified in Article 48_1 of the Town Planning Code of the Russian Federation, i.e. at particularly dangerous, technically complex and unique facilities.

    This state of affairs, when the need to issue a certificate of admission to work depends on whether the capital construction site on which the work is being carried out is classified as a hazardous facility or not, has caused bewilderment on the part of some representatives of self-regulatory organizations. They have repeatedly noted that work affecting the safety of capital construction projects is such, regardless of the objects at which they are performed.

    The positive aspects of the new list include the following.

    The list approved by Order No. 274 actually obliged construction and installation organizations that, along with construction work, carry out geodetic control of the accuracy of the geometric parameters of buildings and structures, to have, in addition to an admission certificate from the construction SRO, also an admission certificate issued by the SRO of surveyors.

    According to the new list, geodetic work performed on construction sites is classified as a type of construction work. Thus, construction and installation organizations performing the specified work no longer need to join an SRO based on the membership of persons performing engineering surveys, which allows reducing the financial costs associated with obtaining permits.

    The types of work on the preparation of project documentation contained in the List can be carried out by an individual entrepreneur independently (in person), and the types of work on engineering surveys, construction, reconstruction, major repairs - only with the involvement of employees in the manner prescribed by the legislation of the Russian Federation.

    3. Recognize as invalid the Ministry of Regional Development of the Russian Federation dated December 9, 2008 N 274 “On approval of the List of types of work on engineering surveys, on the preparation of design documentation, on construction, reconstruction, major repairs of capital construction projects that affect the safety of objects capital construction" (registered with the Ministry of Justice of Russia on January 16, 2009 N 13086), as well as Order of the Ministry of Regional Development of the Russian Federation dated October 21, 2009 N 480 "On amendments to the Order of the Ministry of Regional Development of the Russian Federation dated December 9, 2008. N 274 “On approval of the List of types of work for engineering surveys, for the preparation of design documentation, for construction, reconstruction, major repairs of capital construction projects that affect the safety of capital construction projects” (registered with the Ministry of Justice of Russia on December 22, 2009 N 15789) from the moment this Order comes into force.
