In order to improve the acceptance into operation of federal highways and artificial structures on them, to increase the responsibility of contractors for the technology and quality of work performed:

1. To put into effect and recommend for use from June 1, 2003 warranty certificates for completed construction, reconstruction, major repairs and repairs of roads and artificial structures on them in accordance with Appendices 1 and 2 to this order.

2. Federal highway departments, highway departments, interregional directorates for road construction, directorates for the construction (reconstruction) of federal highways, when accepting into operation completed construction, reconstruction, major repairs and repairs of federal highways and artificial structures, apply warranty passports on them mentioned in paragraph 1 of this order.

3. To recommend to territorial road management bodies of the constituent entities of the Russian Federation the use of the forms of guarantee passports mentioned in paragraph 1 of this order.

4. Entrust control over the implementation of this order to the head of the Department of Highway Construction and Design Methodology N.P. Seregin.

In connection with the structural restructuring of the construction complex, the liquidation of departmental quality control services, and non-compliance with technological discipline in construction, trends towards a decrease in the quality of construction products have appeared.

In order to improve the quality of construction products, protect the rights and interests of consumers and increase the level of responsibility of design, contracting organizations and customer-developers to fulfill contractual obligations during the design, construction and subsequent operation of constructed facilities (buildings and structures), I decree:

Basic provisions

The warranty passport was developed in accordance with the Civil Code of the Russian Federation, other regulations and is aimed at improving the quality of construction products, protecting consumer rights and increasing the responsibility of the contractor, customer and design organization to fulfill contractual obligations during the design, construction and subsequent operation of constructed buildings and structures.

The design organization guarantees the achievement of design technical and economic indicators, including ensuring the level of thermal protection and seismic resistance of buildings and structures.

The design organization and the contractor are responsible to the customer for any deviations from the requirements stipulated in the regulatory and technical documentation and in the building codes and rules binding on the parties, as well as for failure to achieve the indicators of the construction project specified in the technical documentation, including such as production capacity enterprises.

The organization operating buildings and structures must take over the completed construction facility within three days after approval of the acceptance committee act and ensure the occupancy of residential and public buildings no later than 15 days after acceptance into operation in order to avoid a decrease in the performance qualities of new buildings and structures.

The warranty period specified in the warranty passport begins to be calculated from the moment the object, completed construction, is handed over to the operating organization.

The quality guarantee of a constructed building or structure (facility) applies to all components, components and equipment.

Buildings and structures accepted for operation must be carefully inspected by the owners of buildings and structures on whose balance sheet they are located quarterly in the first two years of their operation and annually in subsequent years. At the same time, if hidden critical or significant defects in buildings and structures are revealed, according to GOST 15467-79, claims for them are made within the following terms:

a) Civil works

For critical defects leading to a decrease in stability and strength - regardless of the period of discovery, but not exceeding the standard service life of the structure or structure.

For critical defects leading to a decrease in reliability - within the standard period of technical operation of the building, structure, structure, unit, equipment.

For significant defects leading to a decrease in the operational characteristics of a building or structure - for 5 years, depending on the degree of capital (responsibility) of the building or structure.

b) Engineering support systems

The materials, structures, products and equipment used meet the requirements of standards and technical specifications.

Claims for the elimination of defects arising during the operation of the facility for all types of work should be addressed to the organizations that performed the relevant work at the above addresses, or their legal successors.

If defects are identified for reasons dependent on design, survey, construction, installation and specialized subcontracting organizations, they will be eliminated either at their own expense free of charge, or compensation will be paid in the amount necessary for their immediate elimination, and, if necessary, for performing related work.

The contractor, subcontractor and design and survey organization are not responsible for defects if they occurred as a result of violation of technical operation rules and standard wear and tear of structural parts of buildings and structures, components, including engineering and technological equipment.

Basic provisions

The municipal (territorial) system of use, maintenance and safety of buildings and structures provides for the performance by operating organizations of the following functions:

Organization of their use (registration, control, accounting, work with tenants);

Technical operation (sanitary maintenance of buildings and structures and the surrounding area, maintenance of structures, elements, components, engineering equipment of buildings);

Carrying out all types of repairs.

These instructions must be observed when operating buildings and structures, regardless of their departmental affiliation and form of ownership.

Operating organizations must ensure high-quality technical operation of buildings and structures, help prevent their premature wear and ensure compliance with specified operational indicators throughout the entire standard service life of the building, structures, equipment, and utility systems.

To do this you need to:

1) scheduled general inspections (buildings and structures are inspected as a whole, including structures, engineering equipment and external improvements);

2) scheduled private inspections (individual elements of a building or structure are inspected);

3) extraordinary inspections (carried out in the event of natural phenomena that cause damage to individual elements of buildings, as well as in the event of accidents or when identifying deformations of structures and malfunctions of engineering equipment that violate normal operating conditions.

The presence of defects requiring elimination is established by an act of the operating organization in accordance with the requirements reflected in the warranty passport.

Before carrying out work related to the reconstruction of buildings and structures, extensions, superstructures, redevelopment with dismantling of structures and utilities, functional changes in the purpose of premises, their owners (individuals and legal entities) must obtain permission from the Interdepartmental Commission of the Administration of Maykop in the presence of design documentation, developed and approved in accordance with the established procedure.

Operating organizations are responsible for timely inspection, proper operation and maintenance of buildings and structures.

If defects are detected that arise as a result of improper maintenance or operation of buildings and structures, they are eliminated by the operating organization at the expense of the persons who violated the procedure for operation or maintenance of buildings and structures, no later than three months from the date of their discovery.

In case of failure to eliminate defects within the specified time frame, operating organizations and their officials are held administratively liable in the manner prescribed by law.
